Rent and interest on rent

I am having a case in which my client is having a land on lease basis from kolkata port trust and total rent due is around Rs:- 60,000/- and he paid Rs:-10000/-.this payment was adjusted by port trust in suspense a/c.now he wants to start a suit against port trust.please suggest.

payment must be adjusted in his a/c. he must ask from port trust why they have adjusted 10k in suspense a/c before filing any suit.

Although it is an internal matter of Kolkata Port Trust (lessor)to maintain their own account, however, what can be the reason to adjust the amount of Rs. 10,000/- paid by your client (lessee) in their suspense account when it was paid in the rent account?
Just manage to render arrears/balance of rent to lessor without going into their internal accounting matter.

Your client is a defaulter. The Port Trust might have given him the receipt for payment of Rs.10000/-. It is the internal matter of the Port Trust how to adjust the rent. However, if he wants clarification, he should consult them personally and sort out the matter. Being the defaulter, rushing to the court, will make him to pay the entire rental dues.

Agreed with the views of experts. You may approach the port trust authorities seeking clarification for holding the amount in suspense account, in writing, if their reply is not satisfactory, you may plan to initiate next course of action either legally or otherwise.
