Transfer of property to legal heirs

(Querist) 04 August 2014 This query is : Resolved
Hello. I have a query regarding allotment of a plot by the state development authority. In the lots by the State Development Authority, a plot came up in my father's name but due to some technical issues, it took some time to be formally allotted. In the meantime, my father expired and the process was still not complete. Now the plot needs to be allotted in the name of his legal heirs, that is my mother, my sister and myself. Will Legal Heir certificate suffice for the same? Or will a succession certificate be mandatory?

Each State Development Authority maintains well nourished website, and Procedure of transfer of property is also kept on website.

In case of some states the certification by local MC Councillor, declaration attested by Executive Magistrate, is also accepted for such purpose.

You may go thru it or visit the office, obtain the requisite forms and prepare accordingly.

The succession Certificate takes its own time however it shall be useful everywhere.

A local lawyer well versed with procedures in your city/state can help you.

Contact the office of the State development authority and get the procedure. Complete the formality and get the needful done.

go through the by laws of the society, mostly socities requires only the legal heir certificate issued by the SDM , some of the socities asks for succession certificate which is issued by the civil court and take atleast 6-12 months .
