Hi Sir, Good Morning ! We were living at small home 12 ankhanas & now it not there. and i made it as a plain land & sold it around 2 years ago to one of my relatives. But, seriously,i am not able to sleep because of my Home ( the sold Land ). As it was compulsion at that time, i had sold it. But, my family is suffering a lot for it. Because i lost my father , when i was 1 year boy. And, only the Hose was left by my father. But, i sold it because of major financial problems. Now, i want to get it back at any cost ( am getting mad by thinking about it ). If the party asks us to pay the market value for the land, i will try to do that by any cost. It was sold for 4 lacks at that time. Please help me by considering all the family, Human values and the relationship etc. Thank you Sir,

approach your relative . if he is agreeable pay him market price of land . get sale deed drafted by lawyer .however please note that you cant force your relative to sell you said land

as advised to you telephonically you cant force your relative to sell you your land back . involve some family elders and mpay them more than market price . if they agree then only you can purchase said land

you just cannot do anything. You can only seek their mercy and charity.

Unless

you were compelled by them to see?
price was nominal?
there was misrepresentation of facts in deal?
deal was illegal?
mysweethome (Querist) 17 June 2014
Yes, actually. I was in need of money at that time & they said they will give some money and i can get it back after 3 years of time . but , they did not issued any written documents as they said they are relatives to me . Now, i need my land to be for me . so that my family can live with my father's memories. there is no law for emotions & family values ? Pls help me sir. the land which i sold them is Luxurious place for them ( they are using it for car parking ), but it can be a shelter for me sir. So, pls help me save my parents values & their respect.Thank you.

If you have emotional attachment with the land, you pay the desired amount by them, you have to pay more than the market value.

You can get them pressurized from relatives.
mysweethome (Querist) 17 June 2014
But, its a kind of forcing them , which we can not do legally. So, pls suggest me / guide me with possibilities. Thank you...

you wanted money and you got it.

Buy the land back at today's rate if they are willing to sell it.

My Brother sold him the Land. On just words- ( oral agreement )
stating that, he can get back his land within 3-5 years. Now, he has no written form/proof with him. can he get his land from them ? if yes, what are the ways to proceed ... Thank you.

sale of land has to be by registered sale deed and not by oral agreement .was consideration given by cash or cheque? issue legal notice for eviction
mysweethome (Querist) 25 June 2014
Sir, sale of Land is registered on his name. but, the returning of the land commitment is oral. He said that - my brother can get back the land in 5 years it is oral .
ajay sethi (Expert) 25 June 2014
we have repeatedly advised you both telephonically and in reply to your queries that you cannot get your land back based on oral commitments .

query is resolved

It depends solely upon the sweet will of the present registered owner of the land to sell or not. You cannot compel him to sell the land back to you even on existing market price. So, better try to convince him, if you really is fond of that land. No legal recourse for you is there.
