My wife salary dues

My wife worked with Tech Indira IT Solutions Pvt. Ltd. from March 15, 2012 to August 08, 2012 as Asst. Sales Manager with monthly salary of Rs. 28,000 and T&E reimbursement but she got only Rs. 40,000 for this total period and till date she has not received her final due Rs. 86,309. We continuously following with MD of this company Mr. Vinay Rana but he always gives fake statements that he will pay dues but never received any positive response from his side. He issued a check of Rs. 40,000 to her but that got bounced and we had copy of that check. We filled complaint in labour department but not received any solution.

Please suggest that what is the best way to get dues from that company.

First send them legal notice asking for payment. If it fails to do this again then you can file both criminal and civil case.

Cheque Bounce: You could have filed complaint under N.I. Act.It might have been a meritorious opportunity.

Unpaid wages is debt on employer and complaint with Inspector:

-under (Name of the state) Shops and Commercial Establishments Act,

-under Payment of Wages Act

can be filed.

Your lawyer may opine Complaint u/s 406,420 can be filed, and a petition for winding up the company, Civil suite for recovery of wages can be filed.

She can approach IT/ITeS female employees union
