Succession under mohammedan law

(Querist) 14 April 2014 This query is : Resolved
A male muslim xyz had died intestate and having no debts. He has some immovable properties and movable properties in Hyderabad. He has left the following legal heirs:--
Wife, Four sons, Four daughters, one brother, one sister, mother and father. Can anybody explain me how much share will they get to their shares. It may be explained both in Sunni Law and Shia law respectively.
Anirudh (Expert) 14 April 2014
The following share is applicable both for Shia and Sunni Muslims.

Mother 1/6th
Father 1/6th
Each of the sons 1/9th
Each of the daughters 1/18th

= 1/6 + 1/6 + 4/9 + 4/18
= 1/6 + 1/6 + 4/9 + 2/9
=2/6+6/9
=1/3+2/3
=1 (total property i.e. 100%)
Advocate Ravinder (Querist) 14 April 2014
Thanks Anirudh for your quick reply.
What about sister and brother and wife.
Anirudh (Expert) 14 April 2014
Sister and brother of the deceased will not get anything.
But you did not indicate that he has left behind his wife (widow). Please confirm whether she is alive.
Anirudh (Expert) 14 April 2014
The revised calculation of share:

Wife 1/8th
Mother 1/6th
Father 1/6th
Each of the sons 13/144
Each of the daughters 13/288

= 1/8+1/6+1/6+4(13/144)+4(13/288)
= 1/8+1/6+1/6+13/36+13/72
= 9/72+12/72+12/72+26/72+13/72
= 72/72=1 (total property i.e.100%)
Advocate Ravinder (Querist) 14 April 2014
Yes she is alive. Earlier I have forgotten, later I modified my query. Now you give the equation fully.

Thank you very much.
Advocate Ravinder (Querist) 14 April 2014
1/8 + 1/6 + 1/6 = 33/72 (widow, mother and father)
1 (minus) 33/72 = 39/72
Upto this stage I can understand
----------------------
Can you explain me how this 39/72 should be shared between 4 sons and 4 daughters

Anirudh (Expert) 14 April 2014
I think you have not read my reply fully. I have already indicated as to what each son (13/144) and daughter (13/288) would get.
Rajendra K Goyal (Expert) 14 April 2014
Well and appropriately explained by the expert Anirudh ji.
Raj Kumar Makkad (Expert) 15 April 2014
The daughter get 1/2 compared to sons so the remaining share of 39/72 shall be divided accordingly among brothers and sisters which shall come same as explained by Anirudh.
