Divorce petition withdraw

Dear sirs,

I filed the divorce against my wife on august 2013. now, i think i withdraw my divorce case petition. how to withdraw, and any reason must tell the court. My wife is illegal connection with othr person, i mentioned the petition. Now she didnot attend the court till now.only one day appear iin court but not tell anything in words she give divorce or join to me.please help me.

your wife is not attending court . under circumstances you can get exparte divorce . it is better for you to divorce her if she is having relation ship with another man .


if you want to with draw petition you can do on next date by making written application for with drawal of petition

What is the reason of withdrawal of suit?
Such suits do take time and it is natural that your wife is delaying it.
Withdrawal of suit would only increase your pain than solving the problem.

Sir,Thanks for the advice.
Mr.Ajay sir, She attend the court on 7-3-2014 both parties are present only. .But she not answered any.i think she will take more months to extend the case, After she appear the court the hearing comes on 28-3-2014 and 12-04-2014..12-04-2014 that day mediation . But she didn't come to court. what will happen coming hearing?.

Such cases take about 3-5 years, you should wait.

No apparent reason to withdraw your case at this stage.

Have faith in your lawyer and have his guidance.

there will be further dates in your case . at present your case is for mediation . based on report of counselor case will proceed further . have patience . dont be in hurry to with draw case

It is advised to not to make any haste move of withdrawing the case as of now, have patience, court cases will take time.

Very Very Thanks all expert advocates for the above useful advice and suggestions. My One another question is, How to change my advocate?, what procedure for change of advocate?. My advocate not interested and not follow this case. please help me these doubts.

You can take his NOC on a new Vakalatnama. It is very easy process.

ask your advocate to give NOC on new vakalatnama .i presume you have paid his legal fees till date

I may be continuously not attend the court ( two or three months) and my lawyer also, what happened or any order from court? case dismissed or pending?.pl reply sir.

Dear sir,

Some person told me about this case, this case will run 3-5 years , she ( my wife) may be additionally petition ( maintenance, child custody, dowry , mental torture etc.,) file in coming hearings for delay in divorce case. So, I feared about the expenses in money and waste of time .So i back the case or wait for some time.

if its filed by you then it will be dismissed for default but not the alimony petition if filed by your wife.
