Dear friends,
In relation to sec.325 of Cr.P.C,when in any case chif judi. meg. wants to convict an accused for life under IPC 326, and sufficient evedence is there on record then what should Hon.Chif Judi. Megi. to do? In sec.325 of Cr.P.C there is not spcification about Chif judi.

Plz let me know,if any citation.

I have strong objection and reasonable question whether the CJM has openly declared that he wants to convict an accused for life under the case triable under section 326 IPC? If not then no question can be raised in such a way. It is up to the magistrate trying the case to award punishment keeping in view the evidence on the file. Nothing can be commented and there is no straight jacket formula in such matters.
