No appointment are issued to employees

(Querist) 21 February 2014 This query is : Resolved
Respected Seniors & Experts

I am working in a company where they dont have provision to issue appointment letter. They issue only Offer letter which contains details about the designation offered, date of joining, probation period, Leaves, Notice period, termination etc just like an appointment letter. But still as per law is it acceptable. Please guide me on this.

Yes, it will treated as appointment letter. You accept the offer and hence it becomes a binding contract for both of you.

It will serve the purpose of appointment letter on acceptance.
Rajeev Kumar (Expert) 21 February 2014
It is served as appointment letter as soon as you accept it then you and employer will be entered into a binding contract for both.
T. Kalaiselvan, Advocate Online (Expert) 22 February 2014
The offer letter once agreed, will be treated as an appointment letter in the absence of issuance of any particular letter to that effect by the company. It is legal, go ahead.
Dr J C Vashista (Expert) 23 February 2014
The offer of employer when accepted by you becomes binding on both employer as well employee, no need for fresh appointment letter, if not issued separately by employer.
