Selling property before six months in a co-operative housing society

Respected Experts,
My friend had purchased in May' 2013, a residential property in mumbai, but now he wants to sell it due to his bad financial condition as he is finding it difficult to pay BANK EMI, He got a buyer so he approached Society to obtain NOC to sell his flat but society refused to give NOC and told he cannot sell flat before One Year as per Bye-law.
Please suggest the remedy/solution of such situation.

1. The Society is concerned ONLY with membership. And in a registered Society there should be a minimum of one year between two transfer of membership. Means a minimum membership holding period of one year.


2. You may approach the Coop. Registrar of your ward, with a due application, seeking special permission, to transfer membership, which the Society would be bound to follow.
