(Querist) 08 November 2013 This query is : Resolved
Dear Friends,

I have made an RTI with PWD Moradabad, UP seeking some information from the Executive Engineer/PIO. He replied my application but information certain points were missed. Then I made another appeal reminding the missing informatio of earlier RTI and some additional points. AGain the PIO sent me the same reply which was sent earlier just changed the date of the letter. Hence, I want to appeal further. Can anyone please guide me the procedure of filing the appeal and forum where the appeal will lie.

Thanks

You can easily find out that who is the superior of the Executive Engineer/PIO from PWD/Moradabad Office. I think, the Divisional Engineer would be the Appellate authority.
It is better to file as enclosures along with appeal petition (1) the copy of your application, what information actually, you require and (2) the copy of reply, what the Executive Engineer/PWD given.
So that, the appellate officer, can easily know the mistake committed/done the EE.

Thanks to all.
Pls advise whether the applicant can directly file the appeal or it has to be filed through an advocate.

Thanks

No need to file appeal through advocate. You can file the same. You have to enclose your original RTI application and subsequent requests if any and replies received from PIO. Though it is not mandatory, you also state the grounds for your conclusion that the PIO has not supplied the information required for. Further you can add the reasons for asking the information. (This is also not mandatory).

Appeal is to be drafted individually for each case, no ready made appeal would serve the purpose.
