Tds refund

Resp. sir/mam,


can i file last five yrs returns and refund my tds .

is it possible...plz tell me....

Dear Client,

If you paid excess tax due to mistake of your own or by the Assessing authority in appeal or revision etc you can file for rectification either manually or through online with Income Tax assessment Officer under Section 154 of I T Act 1961 within 4 years from the end of the financial year in which the order sought to be assessed was passed(See sections 154(7)(8). Online facility of refund is available to only to people who have filed their IT return electronically.

After filing the return of income, the same is processed by the department for verification purpose, where processing is completed by the department considering the information given by the assessee in the return of income. Further, if any discrepancies appear apparent from the record, notice of demand may be issued by the department. The assessee is required to comply with the notice, either he has to make payment of the demand raised or submit rectification for the same.
If there is any mistakes in the return originally filed by the assessee, then first rectify the return submitted and generate the new rectification xml. For filing the rectification online you need to log in. Then go to My Account-> Rectification-> Rectification upload and follow instructions to upload the rectified xml file. The rectification request will be processed at Central Processing Centre (CPC) Bangalore and if found acceptable, then a rectification order u/s154 will be issued.

In case of refund if you need to change your Bank Account Number; attachment of a cancelled cheque is required in online rectification request. When an assessee changes Bank Account Number in original data and generates rectified XML file, only provisional rectification request is uploaded. A response sheet will be displayed which is required to be sent along with a cancelled cheque to CPC Bangalore. Only after receipt of this response sheet at CPC Bangalore, the Rectification Request be finally accepted and acknowledgement is generated.However, as per CIT vs. Krone Communication Limited(2010)233 CTR Karnataka 203)if the Assesses has not preferred an appeal/revision etc if application for rectification is rejected, then the original proceedings though mistaken etc become final and no application under Section 154 can be entertained. Assesses forgoes the benefit of rectification and consequent refund if any etc.

First file income tax returns for the last 5 years and claim refund of excess tax paid/TDS deducted. Without filing tax returns you can not claim the TDS refund.

If you have already filed returns take up the matter with Income tax department. If you have not submitted your returns, file the same first.
