Can the application u/s 500 of ipc against me is maintainable?

(Querist) 19 October 2013 This query is : Resolved 
some of the Board members of the Trust including one teacher of the school had illegally collected funds from the employees of the granted schools. I made a complaint to the Assistant Charity commissioner office about the exploitation and extortion of employees by the board members and one of the teachers of the school.in the Complaint, i had written this statement "The alleged teacher was playing the role of an agent of board members of the trust in collecting the funds". Yet the Assstt Charity commissioner have not made any enquiry on my complaint. Yet not a single notice have been issued by the A.C.C. to any of the respondents to attend at the office.The complaint is still pending before the A.C.C.
Now the respondent teacher in the complaint have filed an application in JMFC u/s 500 of IPC for defamation against me stating that the allegations made by me in the complaint are false allegations & they impute the character of him.
can his application is maintainable before JMFC in spite of the fact that my complaint is still pending before A.C.C.
Please suggest me and give me some important citation of SC.
