Delay of condonation

my client is respondant in suit for specific performance of contract. he has accepted copy of plaint in November 2012 and has filled suit in High Court on 15th October,2012 against order of District Judge. The Written statement is not filled in District court as the matter is pending in High Court. The suit is dismissed in High Court on 16th April 2013.the facts have been intimated to the court in July 2013.The Court told to file the Written Statement in August,2013.The opposite party raised the objection in August,2013 and said there is delay in filling the written statement. please guide me how to draft the application for delay of condonation.

simply file Ws on next date in court. no need to file any condonation of delay application unless ordered by court.
