Civil suit

(Querist) 07 August 2013 This query is : Resolved 
In civil suit there are 2 defendants i am def.1 ,the commisioner municipal def.no.2 , now i want to file a application /petition

1-in the cause title should i mention that i am petitioner and

2- for def.2 should i mention respondent no.2
or is it not essential.

There is no hard fast rule so long every thing is clear.

Defendant no.1 -applicant and plaintiff -opposite party and defendant no.2 -opposite party would not confuse any thing.

It is not known which type of petition you want to file. If the parties shall remain same as in the present suit then it shall be better to file counter-claim in the same wuit instead of filing the separate petition.

1. The Cause Title of your petition should be the same as written in the Cause Title of the Original suit,

2. In the body of your petition you can mention "Your petitioner being the Defendant No.1 above most respectfully SHEWETH" etc.
