Transfer of property to mothers name.

Hi all,
My Father expired last year and we have this flat in which my mom was the second owner.
The society needs a letter from our side and fathers death certificate to trf the property to my moms name. can u please suggest me the language which i should use while drafting such letter.
Also my mom wants to nominate my name for the property. however the society says this can be done only after the property is trfd to my moms name, they dont even have to nomination form. can you please provide the same.

I suggest you contact a local Advocate for neessary drafting of your letters. You should go to him alonwith all your documents. We cannot provide you draft letters with out full details.

If your mother is coowner, there is no need for any letter from any one, it is implied and automatic that one of the co- owners/members is surviving and there is no need for transfer of any share.
Your mother shall submit a nomination application to the society.
Your mother is required to intimate the society regarding death of your father and deletion of his name from the register of members/share holder.

your mother had 50%share in flat only . on your father death his 50%share would be inherited by your mother and the children .
the legal heirs have to give NOC to society . we dont provide nomination forms

Agree with the expert ajay sethi ji, letter of relinquishment from all the legal heirs should be submitted to register the flat in the name of your mother.
