Contempt of court procedure!

Sir,

In case my friend does'nt appear for contempt of court on the fixed date with a lawyer and appear alone will they arrest him?

In case he fails to appear before the court on the fixed date Sir?

Generally in such cases, date is fixed for your side of story, your defense, which can be filed even as affidavit.

The best recourse is to clearly mention the circumstances, the reason for your utterance (writing etc) and finally apologize profusely and unconditionally stating that it was unintentional and never to cause any affront to our judicial system. The matter should close here itself.

One thing is very clear that it is never advisable to remain fully absent from the court, at least the counsel must appear with some kind of exemption application. If the accused is present and counsel is not present then generally court grants the adjournment.

If an accused do not appear on the fixed date of his service then court is empowered to issue Non-bailable warrants against him and in that event police has to arrest such person.
