Dtcp approved lay out / request for cancellation / rejected / construction of petrol pump

Dear sir, madam,
Land got approved in DTCP for housing purpose in 1991 and got technical approval . The roads,public purpose space not hand overhead to municipality. The existing owner who got approval in DTCP. Sold the land to 8 parties without showing the approval .

The present owners of the said land went for cancellation and the same was rejected by the DTCP.
In their letter they quoted that the park area and shop site to be converted as house site and the they will consider your request.
The Site is approved in Town and Country Planning No: 299/91 and the file no 24463/2012LA2 clearly shows the present status of the site as Park site. As per the high court orders the reclassification cannot be done in a DTCP approved planning area. The Town and country planning letter no 24463/2012LA2 DT 21.1.2013, rejected the application of the land lord as the Reclassification and cancellation cannot be done.

Ref: The High court of Madras in its judgment W.A NO: 156 OF 2000 AND 45 OF 2003, Clearly stated in Sri Devi Nagar Residences Welfare Association a registered Society. Attached for ref.

Now the present got NOC fro DRO and started constructing a petrol pump in that site who hides the facts from the DRO who is the NOC issuing authority .

The INDIAN OIL CORPORATION who got the Land fro Lease from the land lord also the applicant for 19 years and started the construction activity without obtaining Building permission from the municipality.
The present activity come in a area with roads and garden. The facts were intimated to the oil company and they are still doing the construction activity .
The same was intimated to DRO by the Municipality also.

I have attached the high court order and the rejected letter from DTCP chennai for your ref.
kindly guide what action will stop the construction of the petrol pump .

you will have to engage a lawyer to file suit challenging action of IOC in carrying out construction activites without obatining prior approval from concerned authorities . also pray for stay pending hearing and final dispoosal of suit
