Daughter right in ancestral property -

(Querist) 10 April 2013 This query is : Resolved 
A- a person loses case of ancestral property because of evidences not submitted, case not followed further because of lack of knowledge of evidences. whether the right of his daughter diminished as she is also the coparcener in joint hindu family ? her grand father and great grandfather was also the owner of that property but this fact has not been produced in the court ever. court decided someone A is owner but this person is not A.

If daughter of 'A' was not party in the previous suit and can establish her right as a coparcener independently then a suit for own right CAN LIE WITHOUT ANY BAR OF RESJUDICATA.

She is competent to file such suit and she can definitely insert the pleas which had not been taken by her father in his suit.
