Regarding land

(Querist) 30 January 2013 This query is : Resolved
Respected Sir/Madam

My friend has admitted the civil suite for declaration, Permanant Injunction and suite for do not interfare with Possetion in trial court. The case is regarding agriculture land . The property document was on Aunty's name. After Uncle's death she got married to another persone. But the posetion of land is still with my friend. Now she sold the land to third persone. My friend admitted the case in trial court and submitted the will of his grandmother in the trial court. As per the grandmother will the ownership of land needs to go to my friend. Uncle died 15 years before and Aunty got married to third persone. Since last 14 years the possetion of land is with my friend. He is from Hindu family .He lost the civil suite for do not interfeare with possetion in trial court and that missleneous appeal gone to district court. Again he lost the missleneous appeal in district court and now the missleneous appeal is in High court. Remaning two civil suits is still with trial court. Recently High Court gave the judgement that the possetion will be remain with my friend till the case of ownership does not get clear from trial court.
1) I just wanted to know whetehr the opposite parties (that means Aunty and the third persone who bought the land)have right to go in the supreme court against this decision because this was missleneous appeal which was in the high court.
2) If yes then whether supreme court can take all the cases on board and give one final judgement ( ragarding ownership and permanant injunction as well).

Please advice.

Dear Querist
everybody has right to file an appeal before supreme court if the person is aggrieved with the High court order.
Supreme court is bound to give final judgement on petition, appeal or applications

agree with Nadeem.
