Fabricated evidence by police

Because I lodged a complaint against the IO in another case, I have been framed in a hastily assembled false case where the evidence is fabricated, and the chargesheet and witness statements antedated, etc. I have strong evidence of the police committing forgery in the above. The complainants are also hand in glove.

How can I take action? It seems I need govt sanction for filing case against IO. Can I just file a case against the opp party who filed this case for conspiracy? Any other ideas? Please help.

This is not proper stage to file countercase against IO or complainant. If you are so confidence about the fabrication then let the case decided in which you shall be winner and thereafter you can file for malicious prosecution.

Indeed that is one of the best advise advanced by Mr. Makkad. Litigation in court is like WAR and demands planing NOT SENTIMENT.

I think you should go for quashing. The anomalies in farming false case should certainly help you in the quashing.

I again stand firm on my opinion that if no proper investigation has been made, its entiere benefit shall go in your favour and once you get exonerated from charges, come openly in maidan and do whatever desired.
