Maintenance and welfare of parents and senior citizens act, 20077 d v act etc

(Querist) 13 November 2012 This query is : Resolved 
we are senior citizen,parents staying in a flat since 12 years.owned by
our son,an NRI.The said residential flat was purchased by me(father)as
a power of attoney holder on behalf bof my son and my signature appears
on the sale deed.my name also appears on the share certificate as co-opted member.
my son want to rent out the said flat after vacating us.We donot want to shift from
the present flat.I am an EX-service pensioner drawing meagure pension.
We spend our lifetime earnings tobring him up and educate him as an engineer
and he is employed in a highprofile job in USA.
Do we have any protection under the existing laws. what is the remedy?
As the malicious intentions of the opponent is clear,can I seek protection under law from focible eviction?

Yes you can seek protection under this act. Meet to SDM. Take help of a lawyer. You may seek injunction from civil court also.

the flat belongs to your son he is absolute owner of the said flat . you have out of love and affection spent your life savings to educate him .

if you dont have sufficent funds and are unable to maintain your self you can under maintenance3 of senior citizens act ask your son to maintain you

Apply under Senior Citizens Act here the Tribunal apart from giving maintenance upto rS 10.000/- maximum may pass restraint order against your forceful eviction.

+ Try DV Act against ur son thru ur Wife. It protects ur shared household, residence, and damages + maintenance.
