Dear Sir,

Mr Raju(Seller) sold the property for Rs 9,00,000 on April 18, 2009 to Mr Narayan(buyer). Mr Raju received Rs 1,00,000 lakh from Mr. Narayan as advance amount towards the sale of his property. The agreement was made between the two parties stating that the Mr Narayan is going to pay the balance amount of 8,00,000 within five months from the date of agreement.After waiting for 10 months, Mr Raju decided to sell the property to another person as Mr. Narayan failed to pay the balance amount within the stipulated period. Now, Mr Narayan has filed a case against Mr Raju for the refund of money paid as advance with the interest of 18%. My question is whether Mr Raju had to give any notice before he sold his property. Please advise me on this matter. Thank you in advance.

Yes. He had to give notice prior to the sale of the property to another person. If he had done it so now he could have defended the same.
