Is there any right to cliam ancestor property if mother is not alive
Adv.R.P.Chugh (Expert) 18 June 2012
Yes in mother's lifetime her children have no right in mother's ancestral property. However after her death her interest devolves on her children.

Yes, the children would have rights in the said property.

First and foremost one should be sure that the property in question is 'ancestral'. Unless the querist reveals appropriate facts, it will not be possible to be sure that the property is 'ancestral'. I am not ready to simply go by the statement of the querist that the property is 'ancestral' without verification.

Further more, one should also know as to whether the grand father is still alive - if not when did he die and also as to when did his daughter die.

Above all, one should also know to which State the matter relates (from the name of the querist I surmise that it is Karnataka).
