Construction of a Temple

Dear Collegues:

I have a very typical query.

A group of People in a society has constructed a small temple within their society and started following rituals. However other peoples have filed a case against the first group stating that the construction of temple is illegal. Even court is taking a view that this should be mutually decided. Can any one suggest how should I go ahead so as to prevent the distruction of that Temple.

The other parties are claiming the nuisance due to temple.

Could someone help m to arrange some caselaws / law relating to prevention of distruction of Temple.

Do both the groups belong to the same society? in that case, the only way out is mutual agreement, as far as I am aware.

Was the temple constructed after all its members accepted?

What is the purpose of the Society?, this question applies.

In the situation a decision to be taken with the opinion of the majaority people in the Society .The Society is in Approved lay out & in the lay out proposed temple is shown or not , if it is shown there is no problem !
if the Temple is already cosntruced there will be a situation that the feeligns of that group will be effected . To continue the Temple and to avoid the inconvenience to others there must be proper timings to Temple!

Dear Ms Jayashree / Mr. Rao

The layout of the society does not include the temple sight but then it also include the office of the administrator of the society / office of fire Fighting and other constructions done within the society.Moreover the temple was constructed by a group of people but now it is visited by most of the society members who would neither accept the same nor give their NOC in writing before the Court.

We have a proper timings to the Temple so as to avoid any inconvenience.

Could you please suggest whether there is any case law or any acts which give the protection to the Temple against the destruction?
