Forcing to resing+holding of salary

(Querist) 07 June 2012 This query is : Resolved
Dear Sir,

I have joined my Org. on 16th Jan as an Accounts Manager & after thn alloted work of Merger of group companies.
However till date it has not been complete and I have been asked forcefully to resign otherwise the org. will terminate me.
I was on medical leave for 20 days in april and my salary was kept on hold till day has not yet been cleared.

Now i am left with no job I want to claim for my job or compensation for such termination.

Please guide me in this.

In private organisation you are guided by terms of the job contract , if any.
If there is no such contract then law of equity and fair play would be in force to decide the damages, if any.

In any case these are enforced through civil suit for which be ready to brace for longer version of court battle.

Do not resign. Let them terminate your services and challenge it in court of law and there you can get compensation/damages.

Your question is not clear about whether you are still in job and they are forcing you to resign or you have already resigned, as on one hand you have mentioned that they are forcing you to resign, which means you should be still in job, while on the other you have stated that you have been left with no job. Please clarify what is the real position.

2ndly, you have also not mentioned whether your salary for the entire period right from 16th January or only for the period of your leave for 20 days is withheld?

3rd, you have also not made a mention with what reason you have been forced to resign?

Merely on half fact and without providing clear picture, you may probably not be able to get proper solution.
