What stage is "judgment reserved" stage?

(Querist) 15 April 2012 This query is : Resolved
Ld Counsels,

In the last hearing family court had set husband ex parte and posted a date for "perusal and orders". In the last hearing ex parte evidence was taken whic his a court document and to my knowledge no arguments were heard.

Does this mean that the family court had heard the arguments exparte and the judgment was reserved or is it that after evidence was closed arguments need to happen ex parte. Kindly clarify. Can the last hearing be deemed as fianl hearing

Query is bcos at the stage where final hearing is over and judgment was reserved no application is maintainable.

The court would have stated what the next date is for. Ex-parte arguments or orders.

Normally the evidence is taken on the next date of evidence.

it was stated was that next date is "for perusaland orders"

Judgement is reserved means the mater is finally argued and the court would pass the judgement on the scheduled date or on any date it wishes.

Before the passing of judgment the petition of revoking the ex parte order is very much maintainable and is likely to be allowed as well.

if evidence has been recorded generally arguments are heard and then orders passed . if however court has placed case for orders then it must be for final orders in the case

There is no provision in the CODE OF CIVIL PROCEDURE to fix a date for argument.Date has to be fixed under the code for Final Hearing only. But for practical facility date for arguments are fixed by courts.

In your case since there was exparte evidence led by you and defendant was not present to even cross examine your witnesses, the court thought no occasion to hear arguments, hence fixed date for judgement which it would pass either on date fixed or on any subsequent date found convenient in its' shedule.

Then it is for orders.
