(Querist) 02 March 2012 This query is : Resolved
My friend filed in district legal service authority and opposite party dint turn up. Again my friend filed RCR and after receiving RCR, opposite party is asking with the help of mediators to withdraw RCR.
It seems Opposite party is ready to come to attend marital life.
and my friend does not want divorce at any cost. But he wants to protect from 498 if something happens tomorrow.
could you please suggest what are the affects if he withdraws rcr ?
Thanks

If wife is ready to come, and your friend doesn't want divorce, then what is the problem. Amicably all matter can be settled.Save the family.

amicbale settlement is best option . if husband withdraws RCR and wife is willing to come back your problems are solved .

There is no direct relation of RCR with 498A. If both parties are ready to join hands, why to continue RCR and in that event why to think about evil of 498A.

Yes. What is there to worry when both the parties are ready to reunite??

File a compromise and accept the lady in matrimonial home without withdrawal of petition is my opinion for your friend.

But why he is so shy to ask us directly?????

Is it not a disguised query??????????

Thanks to All.
Prabhakar sir,
how is it possible without closing RCR and allowing her matrimonial home?
If so how long can he continue RCR?
Do you mean to say "File compromise" means need to file in "Legal Services Auhority?
Please clarify.
Thanks

You can file the terms of settlement in the court in which the petition is filed.

In case, in future if something happens, this "terms of settlement" will it be benefitted? Will it help to come out of the bad evil of 498 etc.,
Please advice.
