Need advise to get the partition deed without future problem

(Querist) 10 June 2009 This query is : Resolved 
The property is in mother's name(4 brothers, 2 portion and 4 homes, not equal) and it is not divided and there is no WILL also done. Now mother want's to register 1 portion (ground, first & 2nd floor)to 2 brothers. What steps can be taken(which deed)to do the registration which will not create any problem in future.

I take the proerty as Self acquired / Sridhana/exclussive Proeprty of Mother and advise ;-

Separate Regd Gift Deeds in the name of Each son -separatly with separate Approaches , distinct, with division of land under the Building .

All the other sons and family members to sign as attestign wittnesses- as token of their consnet and not dispute in future !

I think a settlement deed is more safe since it puts all matters to rest.

I am also sugested to execute a settlement deed/family arrangement.

U can make partition deed and regd., it with registrar.
Another way is one of that parties will have to file a suit for partition against other family members and on the date of appearnace to the court u can file a compromise petition and pray for the final decree. Court will take signature of all the parties and final decree will be passed. U can do it also in Lok Adalat. Such compromise decree will be binding on all. There will not be any future problems and compromised in Lok Adalat cannot be challenged.

If there is no dispute between the parties you can opt for partition deed. If your mother needs rights over the property you can opt for WILL or settlement deed. If you need complete ownership over the property you can opt Gift deed.
