(Querist) 25 January 2012 This query is : Resolved
I want to know, According to 7/12 FARMER BOOK "KHEDUT POTHI " 3rd part,If there are 3 minors & 3 Adults who are land owner & If at that time land was sold out.Now when minors becomes Adults, Can they claim there rights over land that had been sold out by adults?

If the immovable property of the minor was sold out without the permission of the relevant civil court then it such sale is illegal and can be set aside on the petition of such minors now became major but the petition for this purpose should be filed within one ear of attaining the majority.

YOU HAVE NOT FRAMED YOUR QUERY PROPERLY WHICH CONVEY SUFFICIENT CONFUSIONS.

HENCE I PROPOSE TO ANSWER TWO ANSWERS DEPENDING UPON CONTINGENCY BETTER KNOWN TO YOU.

IF HEIRS ARE 6 OUT OF WHICH 3 ARE MINORS,AND THREE ADULTS AND SOME ONE CLAIMING GUARDIAN OF MINORS SALE/SOLD THE PROPERTY WITHOUT HAVING TAKEN PRIOR PERMISSION OF THE COURT,THEN MINORS ATTAINING MAJORITY CAN SEEK CANCELLATION OF SALE DEED BY A LAW SUIT.

AND IF ONLY THREE ADULTS HAVE SOLD OR PROPOSING TO SALE ALL PROPERTY TREATING IT TO BE THEIR OWN THEN SALE WOULD BE BAD FOR THE SHARE OF MINORS AND TITLE OF ONLY THREE
ADULTS COULD LEGALLY BE DEEMED TO HAVE PASSED BUT NOT THAT OF MINORS.
