i want to know..
1) if both husband n wife are not present on first date but their respective lawyers are present..what it indicates ?
2) if somebody doesnt want to disclose the name of lawyer ..will it be open to all on the date of the case when both parties's lawyers are present in court?

2. This query lacks sense. Do you think that the persons present in an around the court will go blind when your case is called out??.

why should name of lawyer be hidden?
lawyer has to file his appearance .
opposite party will know name of lawyer appearing on your behalf

okay okay MR Nair i got u .dont get offended.according to a lawyer it may be a senseless question but querry afterall is a querry .u ,the experts are there to solve the queries but just give thought for a second that u are answering to an ignorant person and aboveall to advice in a way to keep their morale high so that they dont lose their confidence.ur reply may stop ppl like me if u reply this way.
anywz i m sorry for a senseless querry but being 50+ in age n u being my son's age i advice u not to ans an querry if u advice like this and which can lower the confidence and next time one has to think hundered times just as u have lowered my confidence and i will also hesitate now.

1. Even if husband and wife are not present on the first day of hearing even then proceeding shall be initiated by court as both parties are being represented through their counsel.
2. No party can hide his lawyer as every lawyer representing any party to the case has to file his vakalalatnama and thus his name is disclosed to all.
So far your grouse is concerned, I think it has unnecessarily been raised by you. None is going to be offenced as really no sense can be derived out of your words. How experts can anticipate your mind? How can we enhance your confidence?
Everyone is not like your son even though your age is more than 50+.

There is no reason to adjournment as the counsels can represent the parties, unless it is specifically asked that they should present themselves in person.

1)It indicates that both spouses have given instructions to their respective lawyers to attend the case.
2)Depends!those there in court knowing both lawyers by name shall know automatically and others interested can know it by a little effort with bench reader.

thanx u all but let me tell u Mr Prabhakar.it is the lawyer who instructed the wife not to go to court on 1st date and may be the same is from husband side as he wz also absent.
next date has been taken after 2 months which i came to know is counseling.
i cant say what the lawyer will instruct then on the next date but u can clear my doubt regarding the same.
if lawyer again instructs the wife not to attend....??indicates what??
or to attend counseling ???indicates what??
in both cases what can be the course of action from a lawyer along with the indications where wife is not going to give divorce.

COUNSELING MEAN A CHANCE TO REUNION/ COMPROMISE., COUNSELING MAY BE CONDUCT BY WELFARE MEMBERS. THEY WONT BE A JUDGES. THERE WILL BE MINIMUM TWO PERSONS. A MALE AND FEMALE MEMBERS., ADVOCATES NOT ALLOWED TO INTERFERE IN COUNSELING.

if any party fails to be present for counselling, one more date may be given. If the said party remains absent repeatedly and avoids to attend the counselling, then thecounsellor will send a report to that effect to the court and the court will take appropriate action on the basis of that report.

May be it was lawyer's instruction Mr. Author Anonymous!! but in law it would be deemed only what i told you.
It is well known to the world that when lawyers are there only they manage how to proceed but they are simply agents and every thing they do is supposed to be done on instruction of the party.

1...its my daghter 's case in which she doesnt want to give divorce .
2.....m also not much aware about the legal proceedings so she has
1...my daughter wz adviced not to go on first date .and the lawyer took next date.
