Name as per will & certificates being different

(Querist) 05 January 2012 This query is : Resolved
Dear sirs,

After receiving your valuable comments 2 days back, I would like to elaborate my query in detail so that I could receive a better clarity on what I should do.

The facts of my case are as follows:

My grandmother wrote a will when I was around 4 years old, mentioning my name as Goutham Ganesan, now I am 28 years old but in all my certificate my name is mentioned as Goutham, Now i want to get patta for my property. Due to the difference in name the Thasildar is refusing to grant patta. What is the remedy?

I was advised by a couple of advocates that:

1) Publishing in the gazette regarding a change in my name from Goutham Ganesan (as mentioned in the will) to C.Goutham (as mentioned in all my certificates) is not possible since I do not have any proof supporting my name as Goutham Ganesan (the only place where this name is found is the will).

2) They also suggested me in order to accquire the property you should change your name to Goutham Ganesan (as mentioned in the will)from C.Goutham & remain as Goutham Ganesan forever. Remaining with this name (Goutham Ganesan) is something which I and my mother do not prefer. So we did not like this suggestion.

3) They also suggested me that if I approach the Court and try to receive an order from the court in my favour, the Court will order my grandmother's will as invalid since the names are different.

4) My Father's name is Chandrasekaran, I have been referred in the will as Goutham Ganesan Son of Chandrasekaran in the will. (Name in all other records being C.Goutham Son of Chandrasekaran)

5) The will has been written in favour of my father's son (ie myself) and my father's brother's son. Both of us to share the house property into to halves.

6) This will was written by my grandmother was registered during 1990 and my grandmother expired 2 years back and only at that time we came to know regarding the content of the will.

Kindly advice suitably,
Thank You,
C.Goutham

Your similar query with the same facts was duly replied in detail two days ago so refer to the same reply.

Facts are same, the reply is same and otherwise also if one has to add some more facts, he should do so in the same thread.

Dear Gautam,
Please find my clarifications to your queries.
1. Publishing in the gazatte does not need any proof of your earlier name. This itself is a proof that C Gautam and Gautam Ganeshan are one and the same person. After publishiing in the gazetter, you shall make an affidavit stating that both are two names of the same person. But now the person is known as C Gautam. In the gazette, you can mention your earlier name as Gautam Ganeshan and which was changed later to C.Gautam.

2. You need not change your name to Gautam Ganeshan for ever. But, for the same of property, you can change your name. But i won't suggest so.

3. You need not approach the court if your work is done by gazette. obtain a copy of the gazette and submit the same to the concerned authority along with an affidavit as suggested above. You can provide puchnama/witness statement too to that effect.

4. You can mention in the affidavit regarding this detail.

5 & 6. No comments.

Please consult a lawyer for proper guidance and services.
