workman compensation act is a social legislation meant for the help of those employees who are required to be compensated by their employers in the event when such employee suffer loss/injury during the course of employment.

The suffer can move to the Commission appointed under workman compensation act (generally Labour cum conciliation officer of the area) with his full claim in the prescribed manner. Authority shall send notice to the employer and after obtaining the reply and evidence from both sides, the case shall be decided as per provisions.

Workmen Compensation Act is an Act to provide for compensation to workmen for injuries by accident.

To claim such compensation, one need to lodge claim with the labour commissioner nii the prescribed manner stating the nature and extend of injuries.
Incase of death of the workman due to the said injury, the legal heir of the workman can claim compensation.

Workmen's compensation Act is changed to Employees's compensation Act. Your query is ambigous. First state the facts of the case, what and how happened and whether the injured or deceased is or was covered under ESIC.
