Neighbor nuisence in the apartment

Hi

I have a neighbor sharing the same floor of my flat in the apartment I reside who threatens and purposefully creates nuisence, he encourages his children playing in the corridor and picks a quarel on confronting the same, the children keep banging the door all the time. After a hard day's work my husband,me and my kids of less than 3 years have to suffer at these peoples hands, can anyone please suggest and help.

He now threatens us of throwing us out from Bangalore!

For speedy remedy inititate proceeding under section 133 or 144 of crpc.
For permanent remedy file a civil suit of prohibitory injunction.

You can also file a complaint before society as the neighbor can be got convinced as litigation with neighbour shall not only be expensive for you but it shall increase bitterness and uneasy atmosphere all the time.

yes try to solve the nuisance with the help of neighbours and resident associations.

try to introspect the reason for this nuisance. Have you provoked him in any way?

if possible try to talk with him in an amicable way than making a "mountain"out of the issue.

I agree with Mr, Raj Makkad.
take following step/ step by step
1] in witness and with hidden voice Recorder/ video, talk to the Point with neighbour, that these are your problem, and it is disturbing you continuously .

2] They may reply, or fight, or say" Go to H**l
3] Send a Legal notice to him, with a Copy to Co-op Society.
3] Directly Complaint to Society, and wait for their Reply. Ask Society to post a Watchman for avoiding this nuisance.
4] Approach Criminal Court as suggested by Barman , and arrange to bang his doors also till he stops banging your door.
So both will get order to maintain peace.
Your purpose will be served.
Use Video Recorder, Keep Witnesses of nuisance as well as communications and threatens to throw you out of Bangalore etc
Evidence if proved, He will be out of your building!

U have remedies under the criminal law as well as in tort, provided U can handle the matter. The greatest difficulty is to get local people to depose in court in your favour.

Civil law suit in your case shall not lie for reasons told by Mr.Makkad but criminal remedies suggested by Mr. Barman are available and to go ahead most practical approach is provided by Mr.V R SHROFF !!!!
