In-laws counselling

Guest (Querist) 05 December 2011 This query is : Resolved
My husband departed me for no reason (Only reason - in-laws dont want him to lead life with me as we are not their caste.). And he has applied for divorce. Now my query is
1. I want the counselling to be happned with in-laws. Because in-laws are the problem creaters. RCR will help to do counsellin with in-laws ? If not how to do this?
2. If RCR can help, how to includ their name?
M.Sheik Mohammed Ali (Expert) 05 December 2011
you file first RCR, thereafter if you like made complaint only in -law then file Domestic violence act or 498aIPC
Shonee Kapoor (Expert) 05 December 2011
Why do you want to include their name? Would your home be saved by that?

And Ld. Mr. Ali, what ground of 498-a is made out?

You would get chance of reconciliation in the divorce proceedings itself.

If you decide to file a case, make sure it is a case based on true facts only. Any false case would not only jeopardise any chances left of saving the marriage, it can also make you liable for reverse legal action.

1. At the time of reconciliation to be made by the court, you may request the court to ask your in laws to be present as well. As the court is loath to give diovrce, it would exercise its every effort to patch you up.

2. There is no need to include their names. Just file RCR.

Mr.Shonee Kapoor advised correctly.
I may add:
You will get chance before Councillor, , and you point it out, request Councilor to ask ur h call all ur in laws. and try to solve it there only.

If succeed, u solved ur prb.
if not, Immediately Apply u/s 24 for Maintenance pendente lite and expenses of proceedings.
Also go for DV Act, ask for Mtn, residence, ur jewelery,
