Hello. Need your expert advise

I am 498 A victim with me and parents on bail having 2 yrs old daughter. Presently case is on stay ( only challen filled) . Wife left daughter and went away and filed 498 A/ 406/ 34 case on which stay is on. I filed section 9 case for sake of my daughter though i was arrested and on bail because of wife.

After 20 months of staying away of wife with her parents , suddenly her parents informed that she died of heartattack which we confirmed that she was poisened. Case of her death is filed

My question: As I am taking care of the minor daughter, can I/ or My daughter claim the istreedhan items as wife is no more( though the items are simple - like her clothes/ some sceneries etc) as these items are only memories for my daughter of her mother.

Presently those items are with her parents as they got it claimed on spurdari on paying some security amount

Please advsie ur expert openion and way ahead

yes,your daughter as well as you are the only legal heirs of all belongings of your deceased wife.
