Settlement Deed

Dear Sir,

I registered a settlement deed to my wife last month. There are two entries for the land extent in the pages 2 and 5.
In the page 2 ( 1900 Sq. feet) and in the page 5 ( 1400 Sq. feet ) were typed.
Actual land extent is 1900 Sq. feet.
Please advice will it be possible to correct the extent by rectification deed.

It is possible !

you have to pay additional Stamp duty for the exces extent! if each item is 1900 square Feet

Thanks for your reply.
According to you, Additional stamp duty for 500 sq. ft has to be paid for rectification.
Am I correct ?

Dear Kaushik,

Please check your settllement deed you have paid stamp duty on 1400 Square feet or 1900 square feet? If you paid stmap duty on total measuring i.e., 1900 sq.ft there is no need to pay additional stamp duty otherwise you have to pay addtional stamp duty for 500 sq.ft

How was stamp duty calculated was it for 1900 Sq Feet or for 1400 Sq feet, in case it is for 1900 Sq feet there is no requirement to pay the additional stamp duty and you can go for a rectification deed, however if you have paid for 1400 Sq feet then you have to pay the deficit and get a rectification deed done.

U can execute the rectification deed and regarding stamp duty U go thru., the advise given by Sanjeev Desai.
