Tenant vefification certificate

My flat in a co-operative society at Mumbai has been given on lease for 11 months since feb 2011. The tenant is a retired bank official of repute staying with his family, without police verification. The society has now issued notice for submission of the verfication certificate within a week, else, they may take action including stopping the tenant entering the society / flat.

I would like to know whether the society can do so, stopping the tenant, considering the fact that my tenant is staying there on registered lease and there is no complaints from the society members.

Your immediate respose will highly be appreciated.

If the Bi laws of the Society so provides that without police verification non tenant would be allowed to stay in the premises then it can restrain the tenant.

In any case you better abide by this beneficial terms and ask for his police verification.

in mumbai on account of increasing security threats cops have been directed to visit all cooperative societies and meet the office bearers . the objective is to find out whether any tenants are staying without police verification .

directions have been issued that no flat should be given on leave and licence without police verification .

you must have obtained society prior approval before giving flat on leave and licence .
please clarify if you have done so as under cooperative socieites act without obtaining prior approval of society no flat can be given on leave and licence basis .

if you have done so then you can request society for one month time to get police verification done .

you can request the tenant to approach local police station . verification dosent take more than one month in any case .

yes only way that you seek one month time from you society to produce the police verification certificate .

Tenant Verification is a easy process- you just need to fill a form for tenant verification that would be available on Mumbai police website or can be availed from a police station. Just fill that form with details of the tenant and his ID proof and submit it to the police station having jurisdiction and take a stamp on the duplicate copy. The process ends for you.
