Resignation

Querist : Anonymous (Querist) 17 September 2011 This query is : Resolved
I am working in a Nationalised Bank. I served my resignation on 15.01.2011. However, I had been advised by HR that due to some staff accountability issues, my resignation can not be processed at that moment. I continued serving even after expiry of 90 days (notice period) on understanding that accountability issues shall be sorted out and I will get formal relase. However, offlate on 02.09.11 I have been issued a transfer order to a rural branch (200kms) away from current metro city. I expressed my inability to relocate due to personal unavoidable circumstances. However, my request has been turned down. I have now decided to quit my service and don't wont to continue any more as its not possible for me to relocate & continue my service.
Please advise URGENTLY.

If you cannot continue in service better you serve your resignation letter afresh.
Guest (Expert) 17 September 2011
Shri Ramachandran has correctly advised for a fresh resignation notice. You can go ahead with that.

Okey sir.
Can i resign stating that I am not in position to continue anymore and as i have served 3 months notice, so i hereby quit and resign from the date of letter.
Raj Kumar Makkad (Expert) 17 September 2011
You cannot take benefit of your earlier notice because you served even after expiry of notice period so it became infructuous due to your own act and conduct so fresh notice is mandatory in your case.
Guest (Expert) 17 September 2011
You can't do that. Your previous notice can't work now. You shall have to serve fresh notice of 3 moths. By resigning from the date of letter, you would just be inviting either disciplinary action on account of absence without permission or would have to pay compensation in lieu of notice period pay.

experts are right in their opinion.

Sirs, I highly appreciate your advices. I However, if its practically impossible to relocate to new place of posting, and inspite of my written plea, i am being given a kind of forced posting.
How to avoid this? If nothing works, I am ready to pay compensation but can not continue any further.
Shailesh Kr. Shah (Expert) 18 September 2011
Ok, but you have to make representation before concerned authority stating your facts. Please note that It is not easy to say that take compensation instead of transfer.
Guest (Expert) 18 September 2011
If you can afford termination by management on account of indiscipline due to unauthorised absence by not joining your new place of posting that can save you from depositing any money.

If you can afford to continuously submit medical certificate of illness during notice period you can also save yor money in lieu of notice period.

I agree with Expert Raj Kumar Makkad.

My advice is that U simply leave the job & demand your retirement benefits, all on the strength of your earlier resignation letter.
The service U rendered was accommodating at their request--U have every right now to turn down the present request made to U.
I do not see any reason why U should go begging for mercy/accomodation or start your resignation process de novo as suggested by some experts.
