Child care leave

Dear Sir,
I am amit kaushik from gurgaon,

My wife join as Haryana Govt. Science teacher in Jan. 2009.

She takes Child care leave for 3 months in 2010 on behalf of my elder son who is 4 years old now. After a short break she joined the school and later took 6 month maternity leave. In that time she born a sweet baby on 18 jan. 2011 and rejoin the school on
28 june 2011.

Now the thing is that as we husband and wife are living alone in gurgaon & both of us are working. So there is no one to keep caring of my six month baby and second thing my elder son often needs medical treatment because of asthma.

But Principal stirtcly denied for leave and when we appeal to higher authority (D.E.O) we did't get any suitable answer.

In this situation what should we do. Please advice

Law/Rules have no place for personal problem of an individual coming in its way. Residing alone is your own problem. Legally your wife can avail two years leave once in her whole service period for the education or welfare of her children after availing all her pending leave in all heads. This facility has been introduced by State of Haryana in its all departments two years back. You can apply for those extra-ordinary leave with pay.

Am also agree with makkad sir. One more thing you not stated anything about your job.. If there is no problem mean you can shift your place to your wife's work place.
