Querist : Anonymous (Querist) 28 June 2011 This query is : Resolved
A hindu Daugther married before 1990 and now she want to partition in the property of father's self acquired property and HUF property.Father left behind three sons and five daughters all married before 1990.
Whether she is right to ask about property ?
If yes then What is the share in the property?
Kiran Kumar (Expert) 28 June 2011
may it be self acquired property or ancestral property now the daughters have equal rights as that of sons.

In your case the property was self acquired and it was not partitioned...may be the marriage of the daughters was solemnized before 1990 they still have a right/ share in the property of the deceased father.

it shall be an equal share as to be given to the sons....if mother is alive she will also succeed with an equal share.

Yes the daughters have equal rights in the properties with the brothers in equal undivided share.

While the daughter would get her share in the inheritance of the self-acquired property left behind by the father, whether or not she will get a share in the partition of the HUF property would depend upon the answer to the following questions:
(i) when did her father die?
(ii)in which State the HUF is.
(iii) Whether her mother was alive when father died?

The father died dt.6/12/2001
In the state of Maharastra
yes.
