Will Deed

(Querist) 22 June 2011 This query is : Resolved 
My aunt made a will deed stating that as she do not have any child she declare me as her heir. Will deed is registered at local sub registrar office. In this will she includes her share of her in laws property also. the hitch is for this property my uncle and after him my aunt is having long legal fight with her in laws ( Kaka Sasur). My uncle is the only heir and after him my aunt. Now my aunt demise and the court case is still pending. If I produce will deed to court will court consider me as her heir? What steps i should have to take to become her legal heir?

yes, court will consider you as her heir.file substitution in court.

Yes apply for substitution under order 22 rule 4 cpc.
