TDS

(Querist) 13 February 2011 This query is : Resolved
Dear Sir,
Is TDS also to be deducted on service tax charged/leviable on any Income.
Pl. advise.
Amit Minocha (Expert) 13 February 2011
According to me TDS it is to be deducted only on the value of service to be provided, s tax is also a tax, again on value of services provided , since it is not an income so TDS cannot be charged over it.

Except for Renting of Immovable property for all other services the TDS is on the net bill(inclusive of Service Tax). There are departmental circulars regarding the same they may be accessed from the official website of Service Tax Department.
B.Chakrapani Warrier (Expert) 14 February 2011
Except for 'renting of immovable property' Income tax is to be deducted on the gross bill amount ie., including service tax.
