Can I move to the HC if I will not get interim relief

Dear Sir,
In one case the CAT has allowed my application and I filed the Contempt Petition against the respondent. The respondent move to the HC and matter has remanded for reconsideration
The employer has terminated my services and filed the separate petition against the termination and prayed for interim relief to put stay on the termination order. The CAT has admitted the petition and issue notice to the respondent employer. The next date of hearing is 28/01/2011
In case if the cat didnot provide me the interim relief whether I can move to the HC seeking for stay on the termination order during the pendency of the petition before the CAT?
