Audio Recording as evidence

Querist : Anonymous (Querist) 22 October 2010 This query is : Resolved
How much importance does audio recording of mobile conversation gets as evidence to prove someone's wrong-doing? Will family court accept a husband's faults if it is proved by showing recording of conversation between him and others?
Kirti Kar Tripathi (Expert) 22 October 2010
yes, it may be used as evidence. however, credibility of this evidence shall be assessed with other evidences.
Devajyoti Barman (Expert) 22 October 2010
The audio recording is not directly admissible as evidence unless the other side admits it to be genuine. If he disputes its authenticity then the court will have to send it to a Govt laboratory to prove its authenticity and thereafter it will have to admitted like any other document. But mere conversation in mobile phone is not sufficient to prove any wrong doing unless it is duly corroborated.

Agree with Mr. Barman.
