Stamp paper authenticity

(Querist) 21 October 2010 This query is : Resolved
my father had an agreement long time back in 1993. But now in one criminal proceeding the opposite party has challenged the stamp paper's authenticity saying that used stamp paper was not purchased on the mentioned date and is forged one. i tried to take out the stamp paper vendor's register but is not traceable and has been weeded out by the revenue department. every thing was done honestly but the opposite party has managed to get the statement from the vendor that the said paper was not sold by him.

what can we do now to prove the authenticity of the stamp paper.

can we send that stamp paper to the Indian Security Press, nashik.

what is procedure of sending the stamp paper there?

A person who alleges has to prove that it is a forged document. Merely alleging is not enough. Further, extracting a statement from the stamp vendor is also not enough, unless the stamp vendor proves that he has not sold it from his records of the day on which the document is stated to have been sold.
In any case, it is not you who forged the stamp paper. Having entered the agreement on a stamp paper with bona fide belief that the stamp paper is genuine is enough. It will not render the transaction void. As all of us know, recently there was a big stamp paper fraud (committed by Mr. Abdul Rehman Telgi), we have to make a research as to what was the fate of those agreements entered into on such forged papers.

The stamp vendor is not empowered to give such certificates.
Moreover his sales chtta and other documents are regulry surrendered by him to the Taluk office or District Registrar office as the case may be.
As such, he is not in the position to give such certificate.
Only DR or Tahsildar can give such certificate
Convey this to your Advocate to manage the criminal proceedings
