Re:Payment of Fees of the Panel Advocate

R/Sir,

I was panel advocate in a Development Authority. Few days back new VC without giving any notice/show cause changed the panel.

Before d panneled I have received only HALF professional fee in 85 cases however entire cases was going to be matured for afgument and judgement,

Can I press development authority for FULL Fee.

Kindly suggest with any S.C. citation

Sir,
As I know, change in the pannel would not effect your existing cases in which you have already filed the power. So , after the decision of the said cases, you may claim the balance fee.

Lot depends on empanelment agrrment you have entered into. Usually no fees after the cut off date. But if have completed deals you can claim and they usually oblige.

Arvind rightly said that you would get fees for the work done. Normally, the authorities (Clients) have a right to change their counsels.

Apart from this, counsels can claim fees for doing a substantial work. In your case, as you were de-panelled, you can claim fees for the work done as per the fee schedule. I think you can have a lien over the briefs till payment is made. But refer to the agreement.
