Missing Documents

(Querist) 10 September 2010 This query is : Resolved
How far and how much is the Court liable for missing documents from Court. Whether certified copies can control the damage. What amount of compensation is payable under the said circumstances.

Chanchal Nag Chowdhury (Expert) 10 September 2010
Sadly nothing. However, the Court may allow reconstruction of the document and/or admitting Secondary Evidence of the lost document.

Is this proposition of yours, "that nothing can be done", applicable to others like Banks and other Creditors who have given loans based on the documents and subsequently the documents are misplaced and lost.
masood ausaf (Expert) 11 September 2010
Well in this case the Court can only help you to get the certified copies of the said documents which are admissible in evidence and are as good as the original. No compensation is granted by the Court.
