Impounding application.

In a suit for partition at the stage of plaintiff's evidence, an impounding application was filed to impound the unregistered partition deed. defendant's contention is that the applicaiton is premature. My question is what is the proper stage to file impounding application before the court. How the court will consiser this application U/s 33 and 34 of the Indian stamp act.

Such application should be moved at earliest possible opportunity.

Under section 33 of STAMP ACT duty is caste on court it self[criminal courts excluded]including arbitrators to take note of the fact of deficiency soon the documents produced before it,hence objection should be raised soon after the document is presented.
