Will probate

My mother has written a registered will stating that her share of property from my late father will go to my son, after her death without probation we have sold a one of property and my sister has been given 1/3 rd share of it but is not aware of the will till date .does this make my will weak for the rest of property?

Repair decayed compound wall , neighbour resisting

There is my compound wall made of shabad stones between my and neighbours property. But the neighbour has put some more stones in support of my wall. It has been like this for 10. Years.
I would like to build a new compound wall of bricks in my property. I am afraid if i remove my stones , neighbours stones will fall in my property and damage his good stones.
Neighbour is not willing to even move his stones temporarily
What should or can i do

Is noc from soc.(of plots) acceptable in place of lease deed

I am currently dealing with a seller 'A' of a plot in a Co.op. Hsg. Soc. (of plots), who has purchased from 'B', who has purchased from 'C'. A lease deed has been executed between the society and 'C'. 'C' subsequently sold the plot to 'B' via a Deed of Assignment, who later sold it to 'A' by a Deed of Assignment. However, no lease deed has been signed between the Society and 'B' or Society and 'A'. No surrender of lease deed has also been signed. The society was not made a a consenting party to the Deed of Assignment. However, in each case (deed of assignment), the society has given an NOC, stating that the new purchaser shall be included as a member of the society. The society has also added their names on the share certificate to that effect (with proper stamps & signs). My question is :
1. If I decide to purchase the property in a similar manner, will the society's NOC suffice or will a lease deed be mandatory?
2. If the original seller i.e. 'C', or 'B' is not available for doing any correction deed or subsequent lease deed, what remedy can I avail?

In a joint WILL only one signatory had signed . unfortunately the second signatory has expired without signing the said WILL .Query is does the WILL in question have any Legal binding?

Gift deed with existing home loan

Hello All,

Let me start with thanking you all for help. We bought a property in 2015 and I was not earning enough so we took home loan on my sisters name which was unmarried at that time. Now I that I have steady income and paying the EMIs. We decided to do property transfer and home loan transfer on my name. As the bank I submitted document for the home loan; however they are saying we need to represent you as a buyer and my sister as a seller and have to complete registration process like buying a new flat. We can not do a GIFT DEED as there will be no money transaction; bank can not approve a loan for me to repay the home loan going on my sisters name. So need suggestion if you have come across this kind of clients and what do you recommend? I don't want to pay 2Lakh again for registering the property on my name were gift deed just take 5K.

Ancestral property daughter's right

Sir, My Query is regarding Ancestral property in Haryana.

We are HINDU family in Haryana and we have some query regarding the ancestral property case.
My mother and maternal grandfather(NANA) have a feud going on for many years. My Maternal grandfather (Nana) has some acres of Land and my maternal grandfather(NANA) will not give any share to my mother.
So, In 2010 my mother had filed a suit for declaration and injunction against my maternal grandfather which was dismissed by the trial court in 2016..

Then my mother left the case.

I was studying so didn’t know about it but now when I came to know about this, I am searching for a solution about how to reopen this case.
I met some lawyers, Every Lawyer has a different story,

One Lawyer is saying “ YOU DON’T HAVE TO FILE ANY CASE NOW, THIS SUIT FOR DECLARATION DOESN’T AFFECT MY MOTHER RIGHT AND AFTER THE DEATH OF MY MATERNAL GRANDFATHER, MY MOM CAN TAKE THE SHARE”

One Lawyer is saying” Suit for declaration is not maintainable, you should have filed a suit for partition, and we can file a suit for partition in the court again.”

One Lawyer is saying” This suit has to be filed again in HIGH COURT for declaration only.

MY QUESTIONS IS:-
SIR PLEASE PLEASE TELL ME WHAT SHOULD I DO?
HOW TO PROCEED, WHICH LAWYER IS SAYING RIGHT?

Daughter right in ancestral property

Sir, to get married daughter's Right in Ancestral property(NANA PROPERTY), which suit is maintainable?

Do we have to file a suit for declaration and injunction?

Do we have to file a suit for PARTITION and POSSESSION ?

Grandfather and mother both are living as of now.

Pls Clarify.

Cidco navi mumbai - oc of flat extension

In Airoli, Navi Mumbai hv purchased CIDCO flat of AL4 type in MAR 2020 in resale. Society has done extention of all 84 flats as per FSI 1 scheme in 1998. That has done prior to my purchase. The person from whom I hv purchased flat given me CIDCO receipt of payment done to CIDCO for extension and also given me the copy of commencement certificate CC of Navi Mumbai Municipal Corporation. But when I asked him about OC then he told that OC is not applicable for this. But now I will hv to apply for name change on property tax of Navi Mumbai Municipal Corporation. So will there be any problem? Bcoz my friends are telling that I will b in big trouble now bcoz OC is not taken by society. CIDCO has issued final order with extended area but in NMMC records the old area exists. So NMMC will ask about additional area.
Pls let me know in this case OC is applicable or not. Pls help...
