Next step for appeal in court

Respected exports, I am helping my friend who is convicted in Sub divisional judicial magistrate in case of 498A & 3/4 Dowry Prohibition Act. My question is (1) May he go directly in High Court to defend her case or it is compulsory to file the case in District Court. (2) In case, any negative judgment in District & High Court. Is it required to go in custody and get bail and further he may apply in upper courts? please guide me the procedure. Regards

Can advocates do business with public sector companies?

I had been applying for lube distributorship and petrol pumps and was recent called in one interview. The company has a clause saying candidate will have to resign if employed and give affidavit that he is not employed in private sector. And they asked me to surrender my licence in case I was selected which was not acceptable to me. Advocates act does not restrict advocates from doing business and guidelines from petroleum ministry only say about resigning from employment (whether public or private). Surrendering license doesn't make sense never heard that some advocate has surrendered his/her license. So If I do such business will state bar stuck me out from state enrolment list? Or initiate any such action?

Sale on the basis of unregistered family settlement deed

Can i purchase a land on the basis of "Un-registered family settlement deed" on Rs 100 stamp paper showing the intended seller got 100% share in this family asset after the death of parents. The deed is signed by all living heirs

Counter claim on partition suit

Dear experts,

My brother files a partition suit before the court and he went to USA and staying there only till the date.

For the same suit, i have filed a reply, in that reply we requested the court for counter claim and paid court fee, and mentioned that we are also seeking the partition.

Now trails will start soon, and court will call my brother but he is not able to attend the court as he is staying in US, if this is the case, will the court dismiss the partition suit? or still court continues the trails as per my counter claim?
is that counter claim will help to partition the property in this case? or any other steps do i need to take to continue the partition suit till i get my partition?

Please suggest me.

Investment opportunities for chsl & fire insurance

Dear Sir / Madam,

Good Afternoon,

I the undersigned is member cum Secretary for a Coop Housing Society Ltd, Pune. My query is other than investing in FDs with Coop / Nationalised Banks are there any other investment options for CHSL where the society will be able to fetch more income than what it is currently obtaining.

Secondly, is it Mandatory to have Fire Safety Audit and All buildings in our society to have Fire Insurance ?

Gift deed

Dear Sir,

We leave in a co-operative society. Its belongs to SKP community and as per bye laws only SKPs are allowed the live in the said society. My aunt has a flat and she is currently member of this housing society. My aunt's daughter got married to a person outside our community. Her mother has made a gift deed to transfer the said flat in her name. My aunt is alive. However the society is not willing to transfer the flat in her name as she got married to non SKP.

My question is, it is legal? If not, what action can be taken against the committee members?
